26/11 attack case judge Tahaliyani elevated to Bombay High Court

Mumbai, March 15 (IANS) Mumbai’s Principal Sessions Judge M.L. Tahaliyani, who conducted the 26/11 terror attack trial, was Tuesday appointed an additional judge of the Bombay High Court.Tahaliyani’s name figures among six Mumbai judges who have been promoted and appointed as additional judges of the high court by President Pratibha Patil.

The others are: Tanaji Nalawade, Madatali Gilani, Madan Joshi, Abhay Thipsay and Utkarsh Bakre.

Before being appointed principal sessions judge, Tahaliyani (47) was an additional sessions judge and presided over the trial of the Nov 26-29, 2008 Mumbai terror attack case.

Last May, he awarded the death sentence to Mohammed Ajmal Amir Kasab, the sole surviving Pakistani gunman involved the Mumbai attack, and acquitted his co-accused Fahim Ansari and Sabauddin Shaikh.

The high court last month upheld the judgment, confirming the death penalty awarded to Kasab.

Last week, Tahaliyani rapped the Enforcement Directorate and refused to grant it custody of stud farm owner Hasan Ali Khan, accused of huge tax evasion and other charges, on the grounds that the evidence presented by the probe agency was not adequate.

During his legal career, Tahaliyani also presided over a special court dealing with cases under the Maharashtra Control of Organised Crime Act.
